What are cookies?

Cookies are small text files sent from the website visited by the user to the user's device (usually to the browser) where they are stored so that the device can be recognised on its next visit. In fact, the cookies are sent from the user's device back to the website again on each subsequent visit.
Cookies can be installed not only by the manager of the website visited by the user (first party cookies), but also by another website that installs the cookies through the first website (third party cookies) and is capable in recognising them. This happens because the website being visited could contain elements (images, maps, sounds, links to web pages of other domains, etc.) residing on other servers.
Pursuant to the Provision issued by the Italian Data Protection Authority on 8 May 2014 “Definition of simplified procedures for the information and the acquisition of consent for the use of cookies” (hereinafter referred to as “Provision”), for cookies installed by third parties, the information and, if the conditions be met, consent obligations shall be borne by such third parties; the website owner, in its capacity as technical intermediary between the third parties and the users, must include in the full notice the links to the latest privacy policy notes and the third party consent forms.
Depending on the purposes, cookies may be technical cookies or profiling cookies.
Technical cookies are installed for the sole purpose of “performing the transmission of a communication on an electronic communication network, or in a manner strictly instrumental to the provider of an information technology service as directly requested by the subscriber or user to provide said service” (see Article 122, par. 1 of Italian Legislative Decree no. 196/2003 (so-called Privacy Code) as amended pursuant to Article 11, paragraph 1, letter b), Italian Legislative Decree no. 101 of 10 August 2018).
They are usually used to ensure efficient navigation of web pages, memorise user preferences, store information about specific user configurations, authenticate users, etc.
Technical cookies can be divided into session cookies, used to record data useful for normal browsing and use of the website on the user computer (allowing, for example, to remember the preferred size of the page in a list) and functional cookies, which allow the website to remember the choices made by the user in order to optimise its functionality (for example, functional cookies allow the website to remember the specific settings of a user, such as the selection of the country and, if set, the status of permanent access).
Some of these cookies (known as essential or strictly necessary cookies) enable specific functions, without which certain operations would not be possible.
Pursuant to the cited article 122, par. 1, Privacy Code, the use of technical cookies does not require the users' consent.
The so-called analytics cookies are assimilated to technical cookies (and therefore, as specified in the Provision, user consent and further regulatory requirements are not required for their installation) if made and used directly by the first party website manager (i.e, without the involvement of third parties) for the purposes of optimisation and to collect aggregate information about the number of users and the way in which they visit the same website, as well as analytics cookies made and provided by third parties and used by the first party website merely for statistical purposes, if, among others, suitable instruments should be applied to reduce the identification capacity of analytics cookies being used (e.g. by masking significant portions of the IP address).
Profiling cookies are used to track user navigation, to analyse user behaviour for marketing purposes, and to create profiles on tastes, habits, choices, etc., in order to transmit targeted advertising messages relating to the user's interests and consistent with the preferences shown when browsing the web.
Such cookies may be installed on the user’s device only if the same has expressed the consent to the modalities set out in the Provision. Based on their duration, cookies are referred to as either persistent cookies, which remain saved on the user's device until they expire (unless removed by the user), or session cookies, which are not saved in a persistent manner on the user's device and vanish when the browser is closed.

Such cookies are strictly necessary for the proper operation of the website or to allow the use of its contents and services as requested by the user. Pursuant to article 122 of the Privacy Code and the Privacy Authority Provision for the protection of personal information concerning the “Definition of simplified procedures for the information and the acquisition of consent for the use of cookies” of 8 May 2014, published in the Official Journal no. 126 of 3 June 2014, it is possible to install technical cookies in user’s browsers for the proper operation of a website, as well as third party analytics cookies, being considered as technical cookies where used directly by the website manager to collect aggregate information about the number of users and the way they use the website, without prejudice to the obligation of an updated notice under article 13 of EU Regulation 2016/679 (GDPR). Is it possible to disable cookies?
